Sales of goods and services
This document governs the sale of goods and services made available on our site. The goods we offer include: consumables, surgical instruments and equipment. The services we offer include: maintenance of surgical instruments. The goods and services linked to this document are the goods and services displayed on our site at the time you access it. This includes all products listed as being out of stock. All information, descriptions or images that we provide about our goods and services are described and presented with the greatest possible accuracy. However, we are not legally bound by such information, descriptions or images as we cannot guarantee the accuracy of each product or service we provide. You agree to purchase these goods and services at your own risk.
Payments
We accept the following payment methods on this website: Credit or debit card, Bank Transfer, American Express (Amex). When you provide us with your payment information, you confirm to us that you have authorised the use of and access to the payment instrument you have chosen to use. By providing us with your payment details, you confirm that you authorise us to charge the amount due to this payment instrument. If we believe that your payment has violated a law or any of our terms of use, we reserve the right to cancel your transaction. The services will be billed in full upon ordering the service.
Shipping and delivery
When you make a purchase on our site, you agree and acknowledge that you will provide a valid email address and shipping address for the order. We reserve the right to amend, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will issue a refund equivalent to the amount you paid. You agree that it is your responsibility to monitor your payment method. Although we aim to provide you with an accurate estimate of shipping times and costs, these may vary due to unforeseen circumstances.
Refunds and Returns
Refund of goods. All goods sold on our website are non-refundable. No returns will be accepted (except in exceptional circumstances and with the express acceptance of DELYNOV). Returned products (sent back in their entirety, in their complete and intact original packaging, and in perfect condition for resale) will then be partially refunded in the form of a credit note; a depreciation of their purchase price inclusive of VAT will be applied. The return shall be at the customer's expense. The product must be returned to the following address: DELYNOV, 31 rue Boulay de la Meurthe, 88000 EPINAL.
Promotional items are non-returnable and non-exchangeable.
In the event of a limited-time promotional offer: '100% satisfied or 100% refunded' valid exclusively on Serafast sutures. Refunds are available within 30 days of receipt, upon return of the product in good condition with proof of purchase. Not applicable after 30 days or to other products.
Limitation of liability
Delynov SAS or any of its employees shall be held liable for any problem arising from this website. Nevertheless, Delynov SAS and its employees shall not be held liable for any problem arising from any improper use of this website.
Indemnity
As a user, you hereby indemnify Delynov SAS against any liability, cost, cause of action, damage or expense arising out of your use of this site or your breach of any of the provisions set out in this document.
Applicable laws
This document is subject to the applicable laws in France and aims to comply with its necessary rules and regulations. This includes the EU-wide regulations set out in the GDPR.
Severability
If, at any time, any of the provisions set out in this document is deemed inconsistent or invalid under applicable laws, such provisions shall be considered null and void and shall be severed from this document. All other provisions shall not be affected by the laws and the remainder of the document shall still be considered valid.

Consumables cannot be returned or exchanged.

Any person whose information is subject to publication on the single public website may exercise their right to rectify the information concerning them by contacting us at the following address :info@delynov.fr However, it is not possible for it to exercise a right to object to the collection, processing or publication of such data, to the extent that the transparency mechanism is made mandatory by law. Delynov SAS undertakes to retain personal data for a period not exceeding that necessary for the fulfilment of the purposes for which they were collected or processed.
Warranty
All products sold by Delynov SAS, with the exception of equipment (or manufacturer's indication), benefit from a one-year warranty from the date of purchase, covering manufacturing defects and latent defects, subject to compliance with the intended conditions of use.
